SCOTUS Comes Through for the Gays

A coast-to-coast collective “yay!” was nearly audible this morning as the Supreme Court ended its spring session on a very high gay note. In a 5-4 decision along ideological lines, the Justices struck down the heinous Defense of Marriage Act (DOMA). The court effectively axed California’s Prop 8, too, by letting stand a lower court ruling invalidating the law in the state. Theoretically, SCOTUS could have struck down Prop 8 itself and given its decision broad national implications, thereby making marriage equality the law of the land, but only a handful of the most idealistic friends of Dorothy thought that would happen.

In the DOMA case, it was Justices Kagan, Sotomayor, Ginsberg, Breyer, and Kennedy who held the majority, while the usual sourpusses filled the minority: Scalia, Thomas, Alito, and Roberts. Scalia is particularly bitter, which we know because he took the extreme measure of reading aloud his dissenting opinion from the bench. If he keeps grousing about it, maybe we should put him on a San Francisco-bound party bus with round the clock drag shows. That’ll cheer him right up.
